There are two main types of Insurance in the Fitness and Martial Arts industry:
Professional Indemnity - this is also known as Professional Liability. As far as the insurance companies are concerned you are running a business and are the ‘Managing Director’. As such you are responsible for telling people what to do and the every day running of that business is your responsibility. If anything goes wrong, that is your responsibility too. Usually this type of insurance may also include cover for Legal help, “goods sold” and slander or libel.
Public Liability - this is often referred to as “member to Member” and what most Instructors do not understand is that they are a “member” of their club or group. PL covers accidents between two or more people participating in your named activity, such as someone being injured by a fall and having an injury which keeps them off work for several weeks or months; in this scenario the injured party would claim off the responsible person’s insurance, be they a student or instructor. PL also covers damage to property (hired halls) and any “third party”; e.g. a Caretaker or member of the public who happen to be injured by a registered student.
NOTE: If anyone is not insured then they are still liable under law and can be sued by the “aggrieved party”. If they are not insured they can be made to pay from savings, property and/or goods, income or other means. In other words, it would be foolish not to protect yourself!
